3 September 2025 Unaccompanied children and families with children who are not citizens of the Republic of Moldova will no longer be placed in state custody at the Temporary Accommodation Center for Foreigners, managed by the General Inspectorate for Migration of the Ministry of Internal Affairs. In addition, individuals facing removal from Moldova will now benefit from clearer guarantees to ensure their rights are respected. Draft amendments in this regard have been approved to improve the efficiency and transparency of these procedures. The adopted amendments put an end to the practice of placing children and families with children in state custody or preventive detention - a measure deemed a form of deprivation of liberty and contrary to the best interests of the child. These changes fully align with the UN Convention on the Rights of the Child and the case law of the European Court of Human Rights. At the same time, a clear procedure has been introduced for the preventive accommodation of foreigners in the Temporary Accommodation Center for Foreigners, based on the decision of the competent migration authority, until expulsion, readmission, or return measures are carried out, or until the individual is placed in public custody. The procedures for declaring foreign individuals undesirable have also been revised to enhance transparency and legal certainty, by explicitly requiring stating the grounds for such decisions and eliminating outdated exceptions from the regulatory framework. The new regulations further clarify the powers of the Temporary Accommodation Center for Foreigners to accurately reflect its legal and operational mandate. In addition, the collection of fingerprint data has become mandatory for all persons accommodated in the center or removed under escort. This must be done within 24 hours using modern "live-scanner" technology, with the data integrated into the State Fingerprint Registry information system. This measure will ensure accurate identification, minimize the risk of false identities, and support more secure management of cases involving illegal residence.
